1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the TidyNest website and any purchase you make from us. By browsing our store or placing an order you agree to these Terms in full. If you do not agree, please do not use our store.

These Terms are governed by the laws of the State of Israel. Nothing in these Terms limits mandatory consumer rights you may have under the laws of your own country.

2. Eligibility

You must be at least 18 years old (or the age of majority in your country) to place an order. By completing a purchase you confirm that you meet this requirement.

3. Products and Availability

We do our best to display accurate colours, sizes, and descriptions. However, slight variations may occur due to photography and screen settings. We reserve the right to limit quantities, discontinue products, or correct pricing errors at any time.

If a product becomes unavailable after you have placed an order, we will notify you and offer a full refund or an alternative product.

4. Pricing and Payment

All prices are displayed in US Dollars (USD) unless otherwise stated. Prices do not include applicable customs duties, import taxes, or VAT, which are the buyer's responsibility.

We accept major credit and debit cards. Payment is processed securely via Shopify Payments. By submitting your payment details you authorise us to charge the total amount shown at checkout.

We reserve the right to cancel any order where pricing was affected by a technical error. In that case, we will notify you and issue a full refund.

5. Order Confirmation

Once your order is placed, you will receive a confirmation email. This email is an acknowledgement — not acceptance of your order. We reserve the right to cancel or refuse any order at our sole discretion (for example, due to suspected fraud or a pricing error). If we do, you will receive a full refund.

6. Order Fulfilment

TidyNest products are fulfilled by third-party supplier and logistics partners. We remain fully responsible to you for the quality of your order, the accuracy of delivery estimates, and your consumer rights — regardless of any delays or issues caused by our fulfillment partners.

If your order cannot be dispatched within the stated timeframe, we will notify you by email, provide a revised estimated delivery date, and offer you the option to cancel your order for a full refund. This obligation applies even where the delay is caused by a supplier or carrier outside our direct control.

7. Shipping

Shipping timelines, costs, and international delivery terms are detailed in our Shipping Policy. By placing an order you acknowledge and accept those terms, including responsibility for any customs duties or import fees applicable in your country.

9. Australian Consumer Guarantees

If you are a consumer in Australia, you have rights under the Australian Consumer Law (ACL) that cannot be excluded, restricted, or modified by these Terms. Our products come with guarantees that cannot be excluded under the ACL, including that goods are of acceptable quality and match their description. If a product has a major failure, you are entitled to a replacement or refund. For a minor failure, we may repair or replace the product. These statutory guarantees apply in addition to our standard Return & Refund Policy.

10. Intellectual Property

All content on this website — including text, images, logos, and graphics — is owned by or licensed to TidyNest. You may not reproduce, distribute, or use any content without our prior written consent.

11. Prohibited Uses

You agree not to:

• Use the site for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to any part of our systems.
• Scrape, crawl, or copy content from the site without permission.
• Submit false or misleading information when placing an order.
• Engage in any conduct that damages, disables, or impairs the site.

12. Disclaimer of Warranties

Our store and products are provided "as is". To the extent permitted by law, TidyNest excludes all implied warranties. This does not affect any mandatory statutory rights you have as a consumer.

13. Limitation of Liability

To the fullest extent permitted by applicable law, TidyNest's total liability to you for any claim arising from your use of the site or a purchase shall not exceed the amount you paid for the relevant order. We are not liable for indirect, incidental, or consequential losses.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel. Any dispute arising from these Terms or a purchase will be subject to the exclusive jurisdiction of the courts of Israel, unless mandatory consumer protection laws in your country require otherwise.
